In the state of Utah, the legal age someone may consent to engage in sexual contact is 16. Given that she is 15 years of age, the 18 year old may be found in violation of the following law. 76-5-401. (1) For purposes of this section "minor" is a person who is 14 years of age or older, but younger than 16 years of age, at the time the sexual activity described in this section occurred. (2) A person commits unlawful sexual activity with a minor if, under circumstances not amounting to rape, in violation of Section 76-5-402, object rape, in violation of Section 76-5-402.2, forcible sodomy, in violation of Section 76-5-403, or aggravated sexual assault, in violation of Section 76-5-405, the actor: (a) has sexual intercourse with the minor; (b) engages in any sexual act with the minor involving the genitals of one person and the mouth or anus of another person, regardless of the sex of either participant; or (c) causes the penetration, however slight, of the genital or anal opening of the minor by any foreign object, substance, instrument, or device, including a part of the human body, with the intent to cause substantial emotional or bodily pain to any person or with the intent to arouse or gratify the sexual desire of any person, regardless of the sex of any participant. (3) A violation of Subsection (2) is a third degree felony unless the defendant establishes by a preponderance of the evidence the mitigating factor that the defendant is less than four years older than the minor at the time the sexual activity occurred, in which case it is a class B misdemeanor.Residency and age of consent.:: July 18, 2006 05:24I'm wondering what the laws are regarding residency and age of consent. For no crime to be committed do both parties have to be over the age of consent in the state in which the sex act occurs, the states in which they each respectively live, or some combination of all three? I have been under the impression that only the laws of the state in which the sex act occurs are applicable, is this true? If a person were to meet a person under the age of 18 for the first time in another state, the only laws that would apply would be that of the state they are both in at the time. However, if a person takes a minor under the age of 18 across state lines, or entices a minor under the age of 18 to cross state lines, with the intent to engage in sexual activity, it is a federal crime, regardless of the age of consent in either state. The laws of the state which the non-minor person resides is irrelavent. Any other sort of situation (e.g. two people who know each other are going to happen to be going on a trip to the same other state), would be a gray area that would need an attorney's advice on the specific situation. 17 and 24:: September 01, 2004 03:26I have a "hush-hush" girlfriend at the age of 17.
