If by "Date" you mean hang out, have NO sexual contact and do it with your parents knowledge and consent, yes, this is perfectly legal. If by "Date" you mean have sexual relations, No, this would not be legal in the state of New York and the 18 year old would be at risk of criminal prosecution if charged.

The following law may apply to your situation if your daughter was under the age of 15 when the sexual act occured and the perpatrator is more than 4 years older than your daughter. New York Penal Code § 130.30 Rape in the second degree. A person is guilty of rape in the second degree when: 1. being eighteen years old or more, he or she engages in sexual intercourse with another person less than fifteen years old; or 2. he or she engages in sexual intercourse with another person who is incapable of consent by reason of being mentally disabled or mentally incapacitated. It shall be an affirmative defense to the crime of rape in the second degree as defined in subdivision one of this section that the defendant was less than four years older than the victim at the time of the act. A person is guilty of sexual abuse in the second degree when he or she subjects another person to sexual contact and when such other person is: 1. Police must follow specific procedures in order to make an arrest.
