Will Jamie Lynn Spears boyfriend, Casey Aldridge, 19 years of age, face statutory rape charges in Louisiana or California?There is a high probability that the answer to this question will be YES! "IF" Casey Aldridge is really the father! There has been much speculation and rumor that he is NOT the father of Jamie Lynn's baby. If he does turn out to be the father, it is likely he will face statutory rape charges and depending on what state they were in when the act occured, it could be a misdemeanor or a felony. Is this another Hollywood statutory rape scandal in the making? |

In the state of Louisiana, the age of consent is 17. In California, the age of consent is 18. The laws are different in each state and regardless of which jurisdcition you look at, it doesn't look favorable for Casey to walk away without a statutory rape charge. At this point there is only speculation about what state would have jurisdiction.
In Louisiana, (statute on page 2 of article) it is a felony with a potential maximum sentence of 10 years OR a maximum fine of $5000 or both.
In California, under Penal code 261.5 [0] it may be a felony or a misdemeanor violation (depending on the age difference and other factors in the case) with a maximum potential fine of $10000 or a minimum of 1year in jail (possibly more) or both.
We were astonished at the number of questions we’ve received on this subject and want to stipulate that as far as we know, no charges have been filed in either state against Casey. There seems to be an almost morbid fascination with fallen celebrities and celebrity scandals. Older sister Britney Spears has certainly fed this fascination with her media shyness and fervant demands for privacy. (I am kidding of course.) Now younger sibling, Jamie is involved in a teen pregnancy, statutory rape scandal. What's next? Hopefully this doesn’t turn into some twisted sister sibling competition for shock value headlines and the spotlight.
That said, Jamie is a 16 year old teen ager. It is our sincere hope that Jamie Lynn, and her child receive the emotional support and stability necessary to get through a very tough time ahead. This is a serious situation for any teen and for any family. It is also our hope that Jamie and her pregnancy will not get swept up in a load of media coverage crap.
Make no mistakes about it; this is not going to be an easy path for Jamie or Casey (if he is the father). It is a struggle for all teens no matter what socioeconomic background they come from. With celebrity status, it can be even more brutal. This is very apparent with the media attention sister Britney’s behavior attracts. It’s been down right ugly over the past year and much of it could have been avoided, if "avoidance" was a part of the Spears marketing plan. Obviously it's not.
Jamie screwed up big time! Just like every other teen on the planet faced with hormone power surges, temptations and a natural curiosity about sex, those teens who consciously choose to experiment with sex at this age and do so without the use of protection often face the “life altering” and sometimes, “life threatening” consequences. Pregnancy is just “one” of many consequences we here about here at SexLaws.org. For many teens, sadly, the ability and the opportunity to be able to “choose” can be taken from them in acts of violence. The pressures and media saturation teens deal with surrounding sex can make the path very tough to negotiate.
