dating

Washington

Ok so I have a boyfriend now for a month that is 14 years old but turns 15 in April. I just turned 18 in September and I was wondering if it is legal for us to date or engage in sexual activity? I read the question below that was similiar to this but decided to ask for sure because I am very curious of the answer.
thanks

Dating is fine as long as there is no sexual "contact" or sexual "intercourse" with the minor and you have consent to date the minor from his parents or legal gardians.

The 14 year old is not "legally" capable of consenting to have sex. In the state of Washington, adult sexual activity with a minor child under the age of 16 is a sex crime. If you were charged in the matter, you "could" be charged with a sexual offense against a minor.

The laws are applied based on the age difference between both parties. The law below may apply in your situation.

RCW 9A.44.079
Rape of a child in the third degree.

(1) A person is guilty of rape of a child in the third degree when the person has sexual intercourse with another who is at least fourteen years old but less than sixteen years old and not married to the perpetrator and the perpetrator is at least forty-eight months older than the victim.

(2) Rape of a child in the third degree is a class C felony.

No matter whether the 14 year old verbally consents or thinks it's ok, it is not ok. The 14 year old and the 18 year old do not share equal footing in the law, nor do they share equal accountablity under the law. The 14 year old is a minor and the 18 year old is an adult, "Legally."
