minor aged boyfriend


I have a friend who is 21 years old and is dating a 17 year old. there has been speculation that people could turn her in, even though the 17 year olds parents know the circumstances. is she at risk? what would be an outcome to this?

The law makers in California have made it unusually simple and clear from a researchers perspecitve.

Under statute 261.5 a male or female under the age of 18 is not legally capable of consenting to sexual intercourse or oral sexual activity. This would apply to all relationships whether the adult is male or female if the minor is under 18. It also applies to homosexual relationships.

The 21 year old is at risk of being found in violation of 261.5 Unlawful sexual intercouse with a minor. According to the statute, if convicted, she could face civil penalties from $2000 to $25,000 and possible jail time.

My son will be turning 18 soon. He has been with this girl for over a year. Her parents approve of them dating. I have informed my son it is illegal for him to have sex with her once he turns 18, but given the history of the girl's character, I'm afraid she may try to file charges later should they break up. I am in the process of obtaining written consent from her parents that state they allow for their daughter to date my son. Is this something that could help us later if we were to end up in court? If they consent to their minor daughter to have sex with my son once he turns 18? Can they give consent?

There is a 17 year old girl who got pregnant by a 21 year old male. She will be 18 in one month, but is 1 month pregnant. She is in California foster care, and her probation officer and social worker both filed reports. What is the probability that the male with be prosecuted in front of a judge? Even with the economy and everyone they are letting out of jail?

My daughter is 17 and will be graduating from high school in June. She wants to date a 24 year old male, who in all fairness is responsible (in college and holds a good job)and well mannered. There is no law that prohibits a 24 year old from dating a 17 year old where there is no sexual contact. If a 24 year old is engaged in a sexual relationship with a 17 year old, given the age difference, it could lead to serious criminal legal problems for the 24 year old male.

24 year old male having consensual sexual activity with 14 year old female. Mother of female has known about the age of the Male and allows her daughter to continue with this relationship. All parties involved have been lying to the females' step-father, telling him that the boy was only 18 years old. Mother of male filed government aid papers claiming female was living in her house (untrue)in a relationship with her son and created an additional burden, thereby she was requesting additional aid from the county, state , and federal governments. Last week, the house of my friend (the unknowing father of the female)was raided by the local PD, Sheriff, and social services. They were concerned that documents were filed stating a 24yr old was in a live-in relationship with a 14 year old. They went to the address of the loady who filed the papers, but no one was home, so they went to the "last known address" of the female (where she actually currently lives) to seek out more information. My friend is furious that both his step-daughter and wife were lying to him, furious at the 24 year old male and wants to press charges, but is concerned his wife would then be in some sort of legal trouble because she consented to the relationship. What are the legal ramifications of both the male, mother of the male, and mother of the female if charges are instigated?

First and foremost, it would be advisable that you seek professional legal council on this matter from a licensed attorney in your jurisdiction.

The main focus of an investigation in a situation like this would usually be on the 24 year old who is having sexual relations with a 14 year old. The 14 year old would be considered the "victim" and the main focus would be her protection.

According to the San Mateo deputy DA, it would be very rare that the parent of a teenager would be prosecuted for a crime in a situation like this; however; if the parent was found to have contributed significantly to the PC 261.5 crime, to the point where their conduct could be deemed aiding and abetting, it is possible that they could be charged with a violation of PC 261.5.

Another alternative for the DA is a misdemeanor charge of contributing to the delinquency of a minor, pursuant to Penal Code section 272.

In situations like this, the parents actions are most often not "criminal" and not looked upon by the DA as "criminal" unless there is proof of neglect, abuse, or proof that the parent condoned the activity to perpetuate other criminal activities such as fraud, prostitution, trafficking, drug use, etc...

Anyone can file a complaint with police against the 24 year old; parents, step parents, neighbors, friends, relatives etc... it is the District Attorney who ultimately determines if there is a criminal case and whether criminal charges will be filed.

From your description, it sounds as though the DA has already opened an investigation to determine if the 14 year old is a victim of a crime. The ball is already be in motion. Again, it would be highly advisable that you seek the advice of an attorney in your jurisdiction.

A person age 18 (legal adult) or older may date a minor (under the age of 18) legally when no sexual contact takes place. It is important that the minor's parents have full knowledge and give consent for the 14 year old to date the 19 year old. If the parents do not give consent, the 19 year old may be subject to legal action should the parents feel motivated to prevent contact with their minor child. The parents have legal authority over the minor and may take legal action on behalf of their minor child whether the minor child agrees or not.

In general, the parents or legal guardians of a 14 year old minor child have legal authority and accountability to protect and maintain control of their child's activities. If the parents feel their child is at risk, it would be prudent to contact an attorney or contact your local authorities, District Attorney or the court clerk for information on actions that may or may not be taken legally. In California, an adult is in violation of the California penal code 261.5 if engaged in sexual intercourse with a minor. All regions, counties and cities have different procedures and policies regarding restraining orders.
