I'm 18 and she is 15, could I go to jail?
Michigan
I'm 18 and my girlfriend is 15, could I go to jail if someone other than her claimed statutory rape? My dad says I would have to prove that we didn't do anything and I say the law would have to prove we did. Who is correct? Please read the laws carefully. I have highlighted the pertinent points. There is not much evidence required to be charged with this crime. 750.520d Criminal sexual conduct in the third degree; felony.(1) A person is guilty of criminal sexual conduct in the third degree if the person engages in sexual penetration with another person and if any of the following circumstances exist: 750.520e Criminal sexual conduct in the fourth degree;1) A person is guilty of criminal sexual conduct in the fourth degree if he or she engages in sexual "contact" with another person and if any of the following circumstances exist: 750.520a Definitions(o) "Sexual contact" includes the intentional touching of the victim's or actor's intimate parts or the intentional touching of the clothing covering the immediate area of the victim's or actor's intimate parts, if that intentional touching can reasonably be construed as being for the purpose of sexual arousal or gratification. (p) "Sexual penetration" means sexual intercourse, cunnilingus, fellatio, anal intercourse, or any other intrusion, however slight, of any part of a person's body or of any object into the genital or anal openings of another person's body, but emission of semen is not required. 750.520h Corroboration of victim's testimony not required. The testimony of a victim need not be corroborated in prosecutions under sections 520b to 520g. |
