is it considered statutory rape if my boyfriend is 17 almost 18, and i just recently turned 15 ? Due to the fact that he is under the age of 18 and you are under the legal age to consent to have sexual contact, a decision would be made by a family court judge as to whether criminal action should be taken. If a minor is under the age of 16 and not a legally married spouse, a minor is not capable "legally" of consenting to sexual contact, which makes it against the law for your boyfriend to have sexual contact with a minor under the age of 16 even if that minor says it's ok.
