if i am 20 is it ok for me to have sex with my 17 year old girlfriend?

This would be unlawful sexual intercourse in the state of California. See "Unlawful Sexual Intercourse" Section 261.5 California Penal code.

Understanding the 3 year age gap and unlawful consent rape laws, I am curious if you can legally engage in sex if the minor was to sign a waiver saying it was ok. Something like I name, fully understand that I am a minor and my partner is a legal adult. I fully concent to engage in sexual intercourse and waive my right to file any legal action against him and am viewing myself as an adult. I also fully understand the negitive side effects associated with sexual intercourse.

Would something like that work or is the law just black and white and there is no way around it?

Multiple problems with this idea. I will point out two.

First; a contract with a minor is generally not legally binding.

Second; this is not a matter of civil law, it is a matter of criminal law. A minor, or a parent, or a person, does not press criminal charges against another person, the State or Federal government prosecutors press charges for violations of state and federal laws when there is evidence supporting the charge.

A waiver will not protect someone from prosecution when a state or federal law has been violated.

If I'm your parent you wouldn't be getting even close to that guy. Don't you know why guys over 18 are looking for dates under 16? Because no one their age would date them! Only scum guys try to get younger dates at this age. Think about it... Do you have anything to talk about? Or you just ride in his car and go have sex somewhere? Does he take you out at all? Your question is very "general" and does not include the ages of the persons involved. It would be difficult to answer it with any accuracy. Parental approval will not protect an adult from prosecution if a law is being violated. It would be up to a District Attorney to evaluate the situation and evidence to make a determination if there is a case and if charges should be filed.

Please visit the California FAQ link for more information. The laws are applied in the same manner whether the minor is male or female.

well to my current knwoledge for statutory rape for anyone over 18 in california is as long as there is a 3 years gap i.e. your 18 and shes 15 then it is impossible to charge you with statutory rape. so right now your ok.

"Yes" it is true.

The age of consent is 18 in California. It is "Unlawful Sexual Intercourse" under California penal code section 261.5 if a person 18 years of age or older has sexual intercourse with a minor under the age of 18. In this situation, the mother is within her parental rights to report the activity to police. It is up to police and the District Attorney to determine if charges will be filed. If charges are filed, given the age difference, it would likely be a misdemeanor case with potential for a fine and jail time. Maximum jail time for a misdemeanor is 1 year. If convicted, past criminal history can have an impact on whether jail time is a part of the sentencing process. There is also potential for monetary civil penalties if convicted in the criminal case. In this situation it would NOT be case requiring registration as a sex offender in the state of California.
